  • Regardless of which group the Lifeline reseller falls into, that reseller, as a corporation, must obtain a permit, pursuant to 68 O.S. § 1364(A). The permit must be obtained prior to engaging in any business, there is a $20.00 fee to apply for the permit, and it must be renewed every three (3) years. Further, the Lifeline reseller must obtain “a separate permit for each additional place of business to be operated” for a fee of $10.00 per location. This requirement and additional fee apply to Lifeline tents, door-to-door sales, and storefront resellers. This permit must be updated “if the location of the business is changed” prior to engaging in or transacting business at the new location. Additionally, each individual going door-to-door must obtain his or her own separate permit. The permit must “be conspicuously displayed at the place of business for which issued in a position where it can be easily seen.”

Failure to obtain proper permits from the Oklahoma Tax Commission may result in a misdemeanor, which for a first-time offense can be a fine up to $1,000.00; and, for any subsequent violations, shall be a felony, with a fine up to $5,000.00 and “a term of imprisonment in the State Penitentiary for not more than two (2) years…”

  • The marketer must have written permission from either the owner of the property where the marketing is taking place or from the individual responsible for the property
  • The marketer must have all required city and county licenses necessary for selling a service at that location
  • The marketing must be done in a manner that it does not create a traffic hazard or distraction
  • Any wireless handset provided in conjunction with the Lifeline Service must clearly and permanently identify the provider of the service
  • The company must provide a list of locations by email to the Oklahoma Corporation Commission where mobile marketing is taking place, including the date, time and location, at least 2 weeks prior to the marketing taking place.
